Terms of Service
The terms that govern your use of our site and any order you place with us.
1. Agreement to These Terms
By using basewear.us or placing an order with us, you agree to these Terms of Service. If you do not agree, please do not use the site or order from us.
Our Return & Refund Policy, Shipping Policy and Privacy Policy form part of these Terms. Where a detail appears in one of those pages, that page governs it.
2. Who We Are
basewear.us is operated by CARING AND CONCERNED INC, a company registered in the United States. We sell and ship within the United States only.
You can reach us through our Contact page.
3. Eligibility
You must be at least 18 years old, or have the consent of a parent or guardian, to place an order. You agree to give accurate contact and delivery information, and you are responsible for keeping any order code we send you private, since it can be used to look up your order status.
4. Placing an Order and When We Accept It
Your order is an offer to buy. The confirmation email we send immediately afterwards is an acknowledgement that we received it, not our acceptance of it.
We accept your order when it moves into production. Until that moment either side can walk away: you can cancel free of charge, and we can decline the order for any of the reasons in section 12.
5. Your Personalization Details Are Final When Production Starts
You choose the size, the colours, the decoration method, the team name, the player name, the numbers and up to three logo positions, and you review all of it in the cart and again at checkout before paying.
Those details can be changed or cancelled while your order is still in Order Placed status. Once it moves to In Production the item is being made and the details are final. Spelling, punctuation and number choices are yours.
6. Pricing, Taxes and Errors
All prices are in U.S. Dollars and may change without notice. Any applicable sales tax is already included in the price shown, so nothing is added at checkout beyond the flat shipping charge set out in our Shipping Policy.
We try hard to display prices accurately, but obvious errors happen. If a clearly wrong price slips through, we contact you before doing anything else and you may keep the order at the corrected price or cancel it for a full refund.
7. Payment
Payments are processed by PayPal, which also handles Visa, Mastercard, American Express and Discover. Your card number is entered on PayPal's systems: we never see it and we never store it.
By ordering you confirm you are authorised to use the payment method. Your order is not confirmed until payment has gone through.
8. Your Artwork: What You Keep and What You Let Us Do
You keep ownership. The logo, artwork, names and numbers you upload remain yours. Nothing here transfers ownership of them to us.
What you allow us to do with them. You grant us a non-exclusive, royalty-free licence to reproduce, print, embroider, resize and store your content for the single purpose of producing and fulfilling your order, and for keeping the records described in section 11. We do not use your artwork for anything else.
What we accept. Image files only: PNG, JPG or WEBP, up to 8MB, at least 250 x 250 pixels. For a sharp result we recommend a PNG with a transparent background at 1500 pixels or larger.
9. Your Responsibility for the Rights in Your Design
By sending us artwork, a logo, a team name, a player name, a number or any other content to be reproduced, you confirm that you own it or have written permission from the owner, and that putting it on a product does not infringe anyone's copyright, trademark, right of publicity or other rights.
In this industry that deserves to be spelled out. The logos, marks, uniform designs and colour combinations of professional leagues, professional teams, colleges and schools are protected, and so are the names and images of professional athletes. Using them on a product needs a licence from the rights holder, and ordering one from us does not give you that licence.
The ordinary case is completely fine: your own child's name, your own team's name, your own club's logo, the number a player on your team wears. If the design is yours or your group's, there is nothing to worry about.
10. Content We Will Not Print
- Third-party trademarks and logos you do not hold a licence for, including professional league and team marks, and school or college mascots and marks.
- The name, number or image of a professional athlete or other public figure, used to suggest their endorsement or as merchandise.
- Content that is hateful, harassing, sexually explicit, or that promotes violence.
- Anything unlawful, or anything that would breach a court order or settlement you are subject to.
We reproduce what you send. We do not verify, and are not able to verify, that you hold the rights to it. Nothing we produce for you means that any brand, team, league or manufacturer endorses, sponsors or is affiliated with your order.
11. Our Right to Refuse or Stop an Order, and How We Store Your Artwork
Our right to refuse. We may refuse or cancel any order at any stage, including after production has started, if we believe the content may infringe someone's rights or is otherwise unlawful, and we are not required to explain our reasoning. If we cancel for this reason, we refund you in full.
Our records. We keep the personalization details of your order, and any file you upload, for no longer than 180 days after your order is delivered, then remove them. We keep them that long so that we can answer a payment dispute or a rights complaint. Our Privacy Policy explains this in full. If you want the same artwork on a later order, please upload it again.
12. When We May Cancel an Order
We may cancel an order, before or during production, for these reasons only:
- An obvious pricing or product description error.
- Artwork that is missing, unusable at print size, or that you have not replaced after we asked.
- Content that breaches section 9 or section 10.
- We cannot reach an acceptable production quality for what was ordered.
- The garment, size or colour ordered is no longer available to us.
- Suspected fraud, or a payment we cannot verify.
In every one of those cases we refund you in full, normally within 5-10 business days. None of this affects your own right to cancel and be refunded when we cannot ship within the timeframe we promised, which is set out in section 8 of our Return & Refund Policy.
13. Your Indemnity for Your Design
You agree to defend, indemnify and hold harmless CARING AND CONCERNED INC, its officers and employees from any claim, demand, loss, damage, settlement or expense, including reasonable attorneys' fees and the cost of responding to a takedown notice, arising from content you submitted to us or from your breach of these Terms. This obligation continues after your order is complete and is not capped by section 17.
14. Reporting Copyright or Trademark Infringement
If you own rights in a work, logo, mark, name or likeness and you believe a product on this site reproduces it without permission, send us a message through our Contact page, choose "Something Else" as the request type, begin your message with "Infringement Notice", and include:
- Your name, the rights holder you represent, and contact details.
- A description of the work or mark, and where your rights in it are registered or otherwise established.
- The address of every page or product on this site that you say infringes it.
- A statement that you believe in good faith that the use is not authorised by you, your agent or the law.
- A statement that the information in your notice is accurate, and that you are the rights holder or authorised to act for them.
- Your signature, electronic or physical.
We review complete notices promptly, and we remove or disable any listing we find to be infringing. We may also cancel and refund any order in production that relies on the content in question.
If your artwork was removed and you believe that was a mistake, reply to us explaining why you hold the rights to it, with the same level of detail listed above. We will look at it again.
Repeat infringement. We refuse future orders from a customer whose content has been the subject of more than one valid complaint.
Notices that leave out the information above cannot be acted on, so please send it in full the first time.
15. Shipping, Delivery, Title and Risk of Loss
Timeframes and charges are set out in our Shipping Policy. We ship within the United States only.
Title to an item passes to you when we have received payment in full. Risk of loss passes to you when the parcel is handed over for delivery, which is why damage and loss in transit are handled as carrier matters under our Shipping Policy rather than as production faults.
16. Returns and Refunds
Returns, refunds and the conditions a claim has to meet are set out in full in our Return & Refund Policy. That page governs, and nothing in these Terms narrows it.
17. Colour, Production Tolerances, Warranty and Liability
Your approval of the order. You review your personalization details in the cart and again at checkout before paying. Placing the order confirms that the spelling, numbers, sizes, colors, decoration method and artwork shown there are what you want. An item produced to match those details is correct, even if you later decide you wanted something different.
Normal variation in custom production. Every item is decorated individually, so small differences are part of the process and are not defects. These include variation in the position of a print or embroidery of up to half an inch, differences in thread or ink color between production runs, differences between the color on your screen and the finished garment, and size differences within normal garment tolerance.
Decoration methods differ. Embroidery and printing produce different edges, different colour depth and different texture on the same artwork. Fine detail and small text survive printing better than stitching.
Fit and sizing. Each product page shows a size chart. Choosing a size is your decision, and a garment that matches the size you ordered is not a defect.
Artwork and text you supply. We reproduce what you submit as submitted. We are not responsible for spelling, punctuation, numbering, resolution or image quality in the material you send us.
Delivery timing. Production and transit times are estimates, not guarantees. Carrier delays, weather, and incorrect or incomplete addresses are outside our control. Your right to cancel for a full refund when we cannot ship within the timeframe we promised is set out in our Shipping Policy and is not affected by this section.
Intended use. Our products are sold for personal and team use. We are not liable for any loss arising from resale, commercial use, or use in any competition, league or event with its own uniform requirements. Confirming that an item meets the rules of your league or organization is your responsibility.
Warranty. Beyond the cases set out in our Return & Refund Policy, our products and this website are provided as they are and as available. To the fullest extent permitted by law, any implied warranty is limited to the shortest period the law allows.
Cap on damages. To the fullest extent permitted by law, CARING AND CONCERNED INC is not liable for indirect, incidental, special, consequential or punitive damages, including lost profits and the cost of any event the item was intended for. Our total liability for any claim relating to an order will not exceed what you paid for the item giving rise to the claim, plus the shipping you paid on it.
Time limit for claims. Any claim relating to an order must be brought within one year of the order date. After that, the claim is permanently barred.
What this section does not limit. Nothing here limits liability that cannot be limited by law, including liability for fraud or intentional misconduct. Some states do not allow certain exclusions, so parts of this section may not apply to you.
18. Our Intellectual Property and Acceptable Use
The text, graphics, product photography, site design and the Basewear name on this website belong to CARING AND CONCERNED INC or its licensors. You may not copy, distribute or create derivative works from them without our written consent.
This does not apply to your own artwork. Anything you uploaded stays yours, and nothing in this section gives us a claim over it.
You also agree not to access the site or our systems without authorisation, scrape or harvest data from it, interfere with its operation, or place orders fraudulently.
19. Events Outside Our Control, Changes, and General Terms
Events outside our control. We are not responsible for delays or failures caused by events beyond our reasonable control, such as severe weather, carrier disruption, strikes, fire, or acts of government. This does not remove our duty to tell you when your order is running late and to offer you the choice of waiting or cancelling for a full refund.
Changes to these Terms. We may revise these Terms. Any change is posted here with a new date at the top, and the version that applies to an order is the one published on the day you placed it.
General. If any part of these Terms is found unenforceable, the rest stays in force. These Terms, together with the policies linked in section 1, are the entire agreement between us. You may not transfer your rights under them; we may transfer ours to a successor of the business. If we do not enforce a right straight away, we do not lose it. We may suspend or end access to the site for anyone who breaches these Terms.
